The Tidy Tutor Inner Circle provides unwavering support and expert guidance, empowering individuals to attain an organized and clutter-free life. We foster a sense of community, promoting accountability and offering valuable instructions via Tidy Tutor courses and workshops. This document details from the outset the way in which we will deliver our services to you. If you are planning to join The Tidy Tutor Inner Circle, (“the Membership”) then you must read these terms and conditions in full prior to purchasing.
- Membership Terms & Conditions (‘Terms’): Key Details
These Terms cannot be varied and in proceeding to purchase the Membership you will be deemed to have accepted these Terms. The Terms set out below apply to the services offered by The Tidy Tutor. Please read them carefully as they affect your rights and liabilities under law and set out the Terms under which The Tidy Tutor (“we”, “our” or “us”) provide services to you, as the purchaser of the Membership. These Terms are subject to any rights you have under consumer law to which we are bound and which cannot be waived by contract.
Please be aware that we may update these Terms at any time. Your continued use of the Membership indicates your acceptance of the terms and agreement to any changes. Changes will be sent to you when/if they occur.
2. Membership Outline
The Tidy Tutor Inner Circle is a membership platform that offers instructional resources, workshops, and support for individuals seeking an organized and clutter-free life. Additionally, it provides a conducive environment for staying focused on course assignments and home projects until completion. Members can access instructional videos and participate in live co-working sessions, fostering a sense of community and preventing feelings of aloneness and overwhelm.
The Membership is an ongoing commitment where you can get regular support and guidance.
The Tidy Tutor Inner Circle is tailored to individuals who face challenges in staying organized, maintaining focus, and letting go of possessions. It is specifically designed for creative individuals who often shift from one project to another, are easily distracted, and struggle to complete tasks. The membership is also ideal for those with a generous nature, who find it difficult to say no despite the negative impact on their own needs. The program aims to help members achieve a clean and clutter-free home, organized spaces, and the ability to effortlessly schedule life’s appointments and commitments with joy.
3. Eligibility
This membership is designed for individuals who have experienced challenges with clutter and seek to lead organized lives. While I do welcome those who simply wish to become more organized, it is primarily oriented toward S.L.O.B.S. (Spontaneous, Lighthearted, Optimistic, and Beloved) individuals. Any non-SLOB participants in this program must agree not to judge. Kathy retains the right to remove anyone from the public forums or program if they are not aligned with the Tidy Tutor culture.
4. Membership Specifics
There are five elements to the TIdy TUtor Inner Circle Membership
- 1 Themed recorded Workshop a month
- 3 Live Online meetings
- Week 1: Time set aside to work on the themed monthly workshop live.
- Week 2: Q and A time and Co-Working Sessions
- Week 3: Co-working session Pomodoro Style
- Weekly Q&A Sessions
- Dedicated Q and A Mondays. Posted in our private Facebook group as well as an email sent to every individual that is part of Tidy Tutor Inner Circle.
- A Private Facebook Group
- Every Friday a Check-in Accountability thread on Facebook as well as a Friday Accountability email is sent to members.
Live Meetings
The live meetings will be led by Kathy Roberts or someone hand-picked and qualified to Coordinate and lead the meeting. From time to time a guest speaker may be present.
The weekly live meetings will take place on Zoom.
During each weekly live session, the purchaser will receive dedicated and organized time set aside to fulfill commitments, take the recorded workshop, and feel supported by the group and Kathy.
The information and guidance provided in this program will draw from Kathy’s extensive 30-plus-year experience as a reformed slob. She has not only practiced the system she teaches but has also been actively involved in teaching and coaching others on The Tidy Tutor system. This system has been adapted from the work of Pam Young and Peggy Jones, as outlined in the book “Sidetracked Home Executives.”
The live sessions will be recorded and made available inside the members’ area for as long as the Tidy Tutor Inner Circle Membership exists. Please note that these recordings are intended exclusively for members and should not be shared outside of the group.
The meetings will take place on Zoom Meetings, allowing members to be visible to others. However, it is entirely up to you whether you choose to have your video camera on during the sessions. You have the option to participate without being seen or heard if you prefer.
Additionally, Kathy reserves the right to use selected portions of our meetings for promotional purposes. Rest assured that any footage used will be carefully edited to ensure your anonymity is maintained.
5. Question & Answer Sessions
Each month, you will have the opportunity to ask questions related to the topics of living organized lives, homemaking, organizing, scheduling, and course subjects. It is important to ensure that your questions align with these topics. Every member will be given a chance to ask questions.
Questions are to be submitted on Mondays. You can do so either in response to the Monday email or on the designated Monday Q and A thread on Facebook. Kindly allow 24-48 hours to respond to your inquiries.
6. Self-Study
In addition to the group workshops and live online meetings, it is understood that members are required to watch the recorded monthly workshop lessons at their convenience. Failure to do so may restrict your ability to benefit from the valuable tips and guidance shared in the live sessions. Please note that all resources and training content will be provided in English, and translations are not available.
7. Private Facebook Group
You will be granted access to a private Facebook group to receive support during your Membership. The Facebook group is intended to foster a sense of community and connect you with individuals who are also in the process of decluttering and getting organized, facing similar challenges and stages.
From time to time, Kathy may post and offer support in the Facebook Group. However, please be aware that there is no guarantee of immediate responses to posts, private messages will not be responded to. For Kathy to provide the service at such a reasonable amount one-on-one help is offered as an extension of the group membership and you can request personal coaching should you wish therefore Facebook mailboxes may not be monitored regularly.
Please be advised that whilst we hope that you will be able to utilize the Facebook group, we make no guarantees as to the availability of the group and/or the content within the group at any time. Therefore, always ensure that you have backup copies of any information shared within the group.
Upon requesting to become a member of the group, you understand that answering the provided questions is a requirement. Failure to do so may result in your request being ignored. If your request is not approved, it is your responsibility to contact Kathy, as there may have been an oversight or an unintentional omission in your response.
IMPORTANT NOTE: Membership in The Tidy Tutor Inner Circle does not require a Facebook account. While the platform offers a private Facebook group for community support, it is not mandatory, and individuals can participate in the Inner Circle without using Facebook.
- Contract Clause: Code of Conduct
- 1. Polite and Respectful Behavior: It is a requirement that all Members maintain polite and respectful behavior towards others within the Membership. In the event that a Member’s behavior is deemed offensive or inappropriate, we reserve the right to take immediate action by removing the Member from the Membership.
- 2. Individual Responsibility: Each person is solely responsible for their own behavior and actions within the Membership. We shall not be held liable for the behavior or actions of any other Members.
- 3. Monitoring and Enforcement: Kathy will monitor the Membership group to ensure that all Members adhere to good conduct and treat one another with love and respect.
- 4. Discretionary Removal: Kathy reserves the right to remove any Member from the group and cancel their Membership, thereby terminating all payments and access to the course and Members area, at her sole discretion.
By agreeing to the terms of this Membership, you acknowledge and accept the importance of maintaining polite and respectful conduct, and understand the consequences of failing to adhere to these principles
- Membership Fees and Payment Terms
Membership Cost: The cost of the Membership shall be determined at the time of subscription and will be exclusive of VAT/Taxes.
Monthly Payments: Upon subscription, you agree to make monthly payments for the Membership via the payment gateway offered, Stripe, Paypal, Apple Pay etc. The initial payment will be taken at the time of sign-up.
Ongoing Subscription: The Membership is an ongoing monthly subscription, and subsequent payments will be automatically processed on the same day each month.
Changes to Content and Price: We reserve the right to modify the content and delivery of the services within the Membership, as well as the associated price point, at our discretion. In the event of such changes, we will provide advance notice, allowing you to consider your subscription.
Fee Increase Notice: We guarantee that any increase in Membership fees will be preceded by a minimum of 28 days’ notice, providing you with ample time for consideration before implementation.
Founding Members’ Price: Founding members who maintain their subscription will retain their original price point. However, in the event of cancellation and re-enrollment, the price will reflect the current subscription rate for founding members, with no exceptions.
By agreeing to the terms of this Membership, you acknowledge and accept the payment terms and the possibility of changes to the Membership content and price, while ensuring that founding members retain their original price point as long as they maintain their subscription.
- Refunds and Cancellation
Refund Policy: Our goal is to ensure your complete satisfaction with the Tidy Tutor Inner Circle Membership, providing ongoing encouragement and support throughout your decluttering journey towards an organized and peaceful life. However, we acknowledge that circumstances may arise when you wish to discontinue your Membership.
As you will have immediate access to all Tidy Tutor Inner Circle Membership resources upon joining, you will not be eligible for a refund of your subscription fees should you decide to leave the Membership. We urge you to carefully consider the Membership details before making your purchase and feel free to reach out to us with any questions regarding suitability. Please note that changing your mind will not entitle you to a refund, and your statutory refund rights will remain unaffected.
Self-Cancellation Option: You may cancel your Membership at any time through your dashboard. In the rare case that you encounter difficulties in canceling through your dashboard, you must provide a 28-day notice via email for cancellation to take effect.
Termination by Us: We reserve the right to cancel the program for any reason without prior notice. In such instances, a refund for the remaining portion of the applicable month or year will be issued.
Immediate Cancellation: Notwithstanding any other rights or remedies available to us, we may immediately terminate your Membership in cases such as:
- Failure to pay Membership fees by the relevant due date
- Committing a repudiatory breach of the Terms outlined in this agreement
- Instances where at our sole discretion
- As decided at our sole discretion from time to time
- Contact and Schedule
It is the intention that the Membership will run continuously and that any training material, live Q&As, and live workshop sessions will be provided as set out above. Should an unforeseen reason arise which causes a session(s) to be postponed they will be re-arranged as soon as possible.
Throughout the Membership, we will be available by email and FB private message. While I give every effort to respond immediately, please allow 24 hours for me to respond.
If you have a technical query relating to accessing the Membership please include “Tech” in the subject line of your email correspondence.
You may see us post on social media outside of our core hours. Not all of these posts are live and some will be pre-scheduled. We are passionate about supporting everyone in the Membership and where we can we may respond to you out of hours but we make no guarantees that this will always be possible.
- Disclaimers
We make no guarantees or claims regarding the success of any member. Each individual is unique, and their abilities are specific to them. Our aim is to help you break free from habits that have fostered a “disorganized” life and change behaviors that may have hindered your progress in the past. The goal is to live a clutter-free, well-managed, and organized life, and I take pride in the fact that those who apply the principles of The Tidy Tutor Instructions and put in the effort often achieve their desired goals. However, I cannot guarantee the same results for every individual.
We are not responsible for any loss of opportunity or any investments which you make. No content in this Membership should be construed as medical advice, whether mental or physical. If you believe that you require medical or psychological attention you should seek assistance from a medical professional immediately.
We ask that all members of the Membership respect the rights of others in respect of their behavior and privacy. We will not be responsible for the action of any members including for any disclosures made by any members based on information that has been shared within the Membership.
- Limitation of Liability and Indemnification
To the fullest extent permitted by applicable laws, we limit liability and responsibility for any harm resulting from your use of all or any part of the Membership. We shall not be liable to you for any damages, including lost profits, whether such claim is based on warranty, contract, tort, or otherwise (even if we have been advised in advance of the possibility of such damages).
If we are found to be liable to you for any damage or loss which arises out of or is in any way connected with your use of the Membership, our liability shall in no event exceed the total of any fees with respect to the Membership received by us from you, during the 6 months preceding the date on which the claim arose.
Nothing in these Terms shall limit or exclude our liability in respect to fraudulent misrepresentation, or personal injury, resulting from our negligence, or any other liability which cannot be limited or excluded by law.
You agree to indemnify, defend and hold us, our subcontractors, and employees, harmless from any claim or demand, including solicitors’ fees, made by a third party due to or arising out of your breach of these terms, or your violation of any law or the rights of a third party.
- Privacy and Confidentiality
Your privacy and the protection of your personal data is important to us. You are responsible for ensuring that your contact details are accurate and up-to-date, at the time of registration, and on an ongoing basis thereafter.
Your personal data is protected as set out in our privacy policy. By providing your personal data you agree to the terms of our privacy policy.
During the course of the Membership, you may have access to confidential information, in particular the personal affairs of other members. In accepting these Terms, you agree that you will not use or disclose to any person, organization, or company, and shall use your best endeavours to prevent the publication of, any confidential information relating to any other member.
You accept that any unauthorized disclosure of personal or confidential information belonging to another may amount to immediate dismissal from the Membership. Should you decide to leave the Membership then you remain bound by the confidentiality and privacy obligations.
Please be aware that some training sessions may be recorded and your name and image/video may be captured. The recordings of the training will be kept and made available to others in the Membership. If you provide or share any information within these sessions about yourself or your business that information will be shared within the group. Should you not wish to be recorded please ensure that if you attend any training your camera is switched off and your name field is changed to “Attendee” with your initials so that support can still be offered but no personal identifiable information will be captured.
Your log-in details must remain confidential, and you must not disclose this information to a third party, without our express permission in writing. If you know, or suspect, that your log-in details have been obtained by a third party, you agree to change your password immediately and provide notification of the same as soon as possible to Kathy@TheTidyTuTor.Com
- Intellectual Property
During your time as a Member, you will be provided with Monthly Themed Workshops, any other bonus courses offered during your time with The Tidy Tutor inner circle, Co-working sessions, workbooks, and templates. At all times the intellectual property rights and copyrights connected with those materials remain with us. You have the right to use the materials as learning tools but you are not permitted to duplicate, republish, reproduce, distribute, translate, or provide copies to third parties. We retain and reserve all of our copyrights.
- Non-Compete
You agree that whilst in Membership, and for a period of 12 months following termination or cancellation of your Membership, you shall not use the confidential information revealed to you for any commercial purpose. In addition, you shall not elicit or entice away any current or potential members by sending “Friend Requests” or otherwise targeting them. You also agree not to become involved in any capacity with any business concern which is in or tends to be in, direct competition with us.
- Force Majeure
Where either party is prevented from or delayed in carrying out its obligations under these Terms, due to circumstances beyond their reasonable control including, but not limited to, weather or catastrophe, governmental actions, war or national emergency, riot, civil commotion, fire, explosion, flood, inclement weather, pandemic/epidemic, lock-outs, strikes or other employment disputes, performance of their obligations shall be postponed until these circumstances end.
- Waiver
In the event that we fail to insist upon your strict performance of any obligations under these Terms, or we fail to exercise any rights or remedies to which we are entitled, this will not constitute a waiver of any such rights and/or remedies available to us.
- Errors and Inaccuracies
There may be information within our Site or the Membership which contains typographical errors, inaccuracies, or omissions relating to the service delivery, pricing, or promotion of the Membership. We reserve the right to correct or amend any errors without prior notice.
- Jurisdiction
These Terms are governed by the laws of The United States of America. The American Courts have exclusive jurisdiction over any matter and proceedings arising out of the Membership.
- Complaints
It is our aim that you are completely satisfied with the Membership. Should you have any feedback please feel free to share it with us as we are always striving to ensure that we provide you with the highest level of service. If you have a complaint about the Membership this should be made to made in writing to Kathy Roberts at Kathy@TheTidyTutor.Com
- General
We intend to rely on the written Terms set out in the Terms and Conditions for the services that we provide to you in delivery of the Membership. These written Terms shall constitute the entire agreement between us.
Should there be any conflict between these Terms and any Membership hosting platform or payment gateway, these Terms shall prevail.
If any provision within these Terms is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect (unless that would contradict the clear intention of the parties, in which case the entirety of the relevant provision will be deemed to be deleted).
No provision within these Terms shall be enforceable by any third party under the Contracts (Rights of Third Parties) Act 1999 or otherwise.
We may update these Terms and Conditions from time to time for legal or regulatory reasons or to allow the proper operation of your service. Any changes will be notified to you as soon as possible.
Frequently Asked Questions
- What happens if I can’t make a live session?
As far as possible, the live sessions will be held on Zoom. The video recording will be posted inside the member’s area within 24 hours of the live call. From time-to-time technology may fail and the recording may be unavailable or of poor visual or sound quality, but since 2011 this has happened only once. We record all live sessions. For the avoidance of doubt, there will be no refunds available for any missed sessions.
- What if I need additional support?
Additional support can be offered to each member in the form of 1:1 support or guidance. We are happy to support you as required, please contact us directly, additional charges will apply.
- What if I am ill during the Membership?
If you are ill or unable to attend a live session for any reason you will be able to watch the recording of that session. If you are ill for an extended period, please let us know and we will support you wherever we can.
- Is the Membership suitable for everyone?
The Membership is primarily intended for individuals aged 18 and above who have encountered difficulties in maintaining an organized life and seek guidance in various areas, including organization, time management, reducing overwhelm, managing celebrations, scheduling, and letting go of excess possessions. For individuals under the age of 18, please contact us to evaluate their readiness for Tidy Tutor Instruction (Inner Circle).
The Tidy Tutor Inner Circle is specifically designed for individuals who show initial self-motivation to start a course or pursue a goal but struggle to maintain focus and often abandon their endeavors before completion. They recognize their need for additional support, guidance, and encouragement to stay on track and achieve their desired objectives successfully.
